Terms and acceptable use

1. Agreement

By creating an account or using TornHost ("Services"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, do not use the Services. These Terms apply to all users, including visitors, registered accounts, and paying subscribers.

2. Services

TornHost provides game server hosting infrastructure, primarily for Minecraft and related game servers. We reserve the right to modify, suspend, or discontinue any feature or aspect of the Services at any time, with or without notice, and without liability to you.

3. Account registration

You must provide accurate and complete information when creating an account. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Accounts may not be shared, transferred, or sold to other parties without prior written consent from TornHost.

4. Payment and billing

  • Paid plans are billed on a recurring monthly or annual basis until cancelled.
  • Prices are displayed in EUR/USD and may be changed with at least 30 days' notice before the change takes effect.
  • If a payment fails, your server will be suspended within 7 days if the outstanding balance is not resolved.
  • You are responsible for any applicable taxes in your jurisdiction. Displayed prices may be exclusive of local taxes.
  • Subscription downgrades or cancellations take effect at the end of the current billing period.

5. Refund policy

New subscriptions are eligible for a full refund within 72 hours of the initial payment, provided you have not violated these Terms and have not made excessive resource usage. Refunds are not available for renewal charges, partial billing periods, accounts terminated for policy violations, or plans purchased at a discounted rate. To request a refund, contact support within the eligibility window via Discord.

6. Acceptable use

You may use the Services for personal or commercial game server hosting. You are responsible for all activity on your account and servers, and must ensure your use complies with all applicable laws, regulations, and these Terms. You must not take any action that interferes with, disrupts, or degrades the Services or the experience of other users.

7. Prohibited activities

The following activities are strictly prohibited and will result in immediate account termination:

  • Mining and attack tools — cryptocurrency mining, distributed denial-of-service (DDoS) tooling, brute-force attack scripts, or any automated exploitation framework.
  • Malicious software — hosting phishing pages, malware, ransomware, exploit kits, or any software designed to cause harm.
  • Illegal content — hosting content that violates applicable law, including copyright infringement and child sexual abuse material (CSAM).
  • Abusive resource usage — sustained resource consumption that significantly degrades service performance for other users.
  • Unauthorised resale — reselling server resources or subleasing infrastructure without prior written permission from TornHost.
  • Security circumvention — attempting to bypass authentication, rate limiting, firewalls, or any other security control.

8. Content and data

You retain ownership of all content and data you store on your servers. By using the Services, you grant TornHost a limited, non-exclusive licence to store and process your content solely for the purpose of providing the Services. We do not access your server content except when required for support at your request, abuse investigation, or legal compliance. You are solely responsible for ensuring your content does not violate third-party intellectual property rights.

9. Termination

TornHost may suspend or permanently terminate your account at any time for a violation of these Terms. In cases involving serious violations — such as illegal content, DDoS activity, or malware — termination will occur without prior notice. You may cancel your account at any time from the account settings panel. Upon termination, server data is deleted within 7 days unless a longer archive period has been separately agreed. Termination does not entitle you to a refund except as provided by the refund policy above.

10. Service availability and disclaimers

Services are provided "as is" and "as available" without warranty of any kind. TornHost does not guarantee that Services will be uninterrupted, error-free, or free from data loss. Free-tier and beta-tier plans carry no uptime SLA. Any specific uptime commitments apply only to plans where they are explicitly documented at the time of purchase.

11. Limitation of liability

To the maximum extent permitted by applicable law, TornHost's total cumulative liability for any claims related to the Services is limited to the amount you paid in the three calendar months preceding the event giving rise to the claim. TornHost is not liable for any indirect, incidental, consequential, special, or exemplary damages, including loss of data, revenue, or profits, arising out of or related to the use of the Services.

12. Governing law

These Terms are governed by the laws of the Netherlands. Any disputes arising under these Terms will be submitted to the exclusive jurisdiction of the courts of the Netherlands, unless applicable consumer protection law in your local jurisdiction mandates otherwise.

13. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated via email or in-panel notice at least 30 days before taking effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Services before the effective date.
